# Terms of Use for the NixQuest beta
**This English page is a courtesy translation. The German version (`terms.de.md`) is the legally binding text, and German law governs this agreement (see Section 10).** If the two versions differ, the German version controls.
These terms apply to the free, invite-only beta version of NixQuest. They are not terms for a paid service; those will be published separately, and reviewed by a lawyer, before any paid launch.
## 1. Provider and scope
NixQuest is provided by {{OPERATOR_NAME}}, {{SERVICE_ADDRESS}} (see the legal notice / Impressum). By registering an account or using the demo feature, you accept these terms.
## 2. Minimum age
NixQuest is only for people aged 16 or older. By registering, you confirm you are at least 16 years old.
## 3. What we provide
NixQuest is an interactive online course for learning Nix. During the beta:
- use is free of charge;
- registration requires an invite code;
- part of the course can be tried without registering ("demo");
- the feature set, content and availability may change at any time.
## 4. No warranty beyond what the law requires
During the beta, NixQuest is provided "as is" with no guarantee of availability. There is no entitlement to uninterrupted availability, error-free operation, or any particular response time for outages. This is without prejudice to the statutory rules that, in any case, already lower the standard of liability for services provided free of charge under German law (e.g. the reduced-diligence standards for gratuitous contracts, such as Sections 599 and 521 of the German Civil Code (BGB) applied by analogy).
## 5. Liability
We are liable without limitation for intent and gross negligence, under the mandatory provisions of the German Product Liability Act, and for damage arising from injury to life, body or health.
For ordinary negligence, we are liable only for breach of a material contractual obligation (a "cardinal obligation") — one whose fulfillment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely — and in that case liability is limited to damage that was foreseeable and typical for this kind of agreement. Because use during the beta is free of charge, the statutory relief from liability for gratuitous services applies in addition, to the extent it is applicable.
Liability for the loss of learning progress, feedback or other data stored in NixQuest is excluded within the limits above; we recommend separately backing up anything important to you (e.g. code you wrote outside the exercises).
## 6. Acceptable use
You agree not to:
- use someone else's access (account or invite code) without permission;
- disrupt the service through automated mass access, denial-of-service attempts, or by circumventing access controls (e.g. bot protection, rate limits);
- **abuse the Nix evaluator embedded in NixQuest ("NixBox")** — in particular, do not attempt to exhaust resources through the browser-based evaluation environment (e.g. deliberate infinite loops or excessively large evaluations beyond what an exercise requires), attempt to bypass its sandboxing, or use the evaluator for purposes outside the course;
- post unlawful, abusive or discriminatory content in feedback, comments or problem reports;
- use automated scripts to bulk-download or reproduce course content.
If you breach this section, we may temporarily suspend access or terminate your account (Section 7).
## 7. Termination and suspension
You can delete your account yourself, with immediate effect, at any time in account settings.
We may end access to the beta at any time without giving reasons, with reasonable notice (e.g. by email) — in particular if the beta phase ends or transitions into a paid service. If you breach Section 6, we may also suspend access or delete your account immediately, without notice.
## 8. Intellectual property
The course content (text, exercises, graphics) is protected by copyright and may only be used as part of the course's intended use. The Nix evaluator used in the course, "NixBox", is based on tvix-eval and licensed under the GPL-3.0; its source code is published separately. All other parts of the application and the course content remain proprietary.
## 9. Changes to these terms
We may change these terms, in particular to reflect changed features or legal requirements. We will give you reasonable notice of material changes (e.g. by email or a notice in the app). Continuing to use the service after a change takes effect means you accept the updated terms; if you object, you can delete your account.
## 10. Governing law and venue
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This does not affect any mandatory consumer-protection provisions of the country where you habitually reside, to the extent you are a consumer.
## 11. Severability
If any provision of these terms is or becomes invalid, the validity of the remaining provisions is unaffected.
